This Artwork & Intellectual Property Policy explains how Jolly Clothing Ltd t/a Charity Printwear ("we", "us", "our") manages customer artwork, logos, branding, intellectual property and design files supplied in connection with quotations and orders.
It also explains the responsibilities of customers when providing artwork and the respective ownership rights relating to artwork created, amended or reproduced by us.

You are solely responsible for ensuring that the artwork may lawfully be reproduced.
Copyright and all other intellectual property rights in customer-supplied artwork remain with the original owner.
Nothing within our services transfers ownership of your intellectual property to us.
Likewise, nothing within this policy transfers ownership of our own intellectual property to you.
By submitting artwork to us, you grant Jolly Clothing Ltd a non-exclusive licence to:
This licence continues only for as long as reasonably necessary to fulfil our contractual obligations and retain artwork for repeat orders, unless you request deletion where legally permissible.
Where artwork supplied requires adjustment before production, we may:
Significant artwork recreation or design work may incur additional charges, which will be advised before work is undertaken wherever practicable.
The quality of the finished product is heavily influenced by the quality of the artwork supplied.
Low-resolution files may not reproduce satisfactorily.
Where suitable artwork is not available, we may recommend that artwork is recreated before production.
Whilst every reasonable effort is made to improve supplied files, we cannot guarantee high-quality results where the original artwork is of poor quality.
Before production begins, customers may receive a digital artwork proof or visual mock-up.
The purpose of this proof is to allow you to check:
It is your responsibility to review the proof carefully.
Approval confirms that you authorise production to proceed using the approved artwork.
Once artwork has been approved, responsibility for the accuracy of the approved design passes to the customer.
We cannot normally accept responsibility for errors that were visible within an approved proof, including:
If changes are requested after approval, additional charges and revised production schedules may apply.
Every reasonable effort is made to reproduce colours accurately.
However:
Where Pantone references are supplied, we will aim to achieve the closest practical match but cannot guarantee an exact colour reproduction in every production process.
All production processes include recognised manufacturing tolerances.
Minor variations in:
are considered acceptable within normal commercial manufacturing standards and do not constitute defects.
We recognise that customers may choose to supply artwork created or assisted using artificial intelligence (AI) tools.
Where AI-generated or AI-assisted artwork is submitted, you confirm that:
We do not independently verify the ownership or originality of AI-generated content and reserve the right to decline artwork where there is a reasonable concern regarding copyright, trade mark infringement or other intellectual property rights.
Many of our customers ask us to reproduce company logos, school crests, charity branding, sports club emblems and other third-party trade marks.
By requesting us to reproduce such artwork, you confirm that:
We may request evidence of permission where appropriate.
We reserve the right to refuse to reproduce artwork where we reasonably believe it:
Where possible, we will explain the reason for our decision and, where appropriate, invite you to provide alternative artwork.
You agree to indemnify and hold harmless Jolly Clothing Ltd against any claim, loss, damage, liability, cost or expense arising from the reproduction of artwork, logos or other materials supplied by you where such claims relate to alleged infringement of copyright, trade marks, design rights or other intellectual property rights.
This indemnity applies only to the extent permitted by applicable law and does not affect any rights you may have under consumer protection legislation.
To help provide a quicker and more efficient service, we may retain approved artwork, production files, embroidery files and associated order information after an order has been completed.
Retaining artwork allows us to:
Artwork is retained in accordance with our Privacy Policy and only for as long as reasonably necessary for these purposes or to comply with legal obligations.
Where previously approved artwork is reused for a repeat order, we will normally reproduce the artwork as it was last approved unless you instruct us otherwise.
It is your responsibility to notify us if any aspect of the artwork, wording, colours, branding or design requires updating before production begins.
We cannot accept responsibility for reproducing previously approved artwork where no amendments have been requested.
If you wish us to delete artwork that we hold on your behalf, you may contact us at any time.
Where there is no legal or contractual reason requiring us to retain the files, we will take reasonable steps to delete them from our active production systems within a reasonable period.
Deletion of artwork may mean that:
Certain records may continue to be retained where required for accounting, legal, contractual or regulatory purposes.
From time to time, we may photograph completed products for quality control, internal training, marketing or portfolio purposes.
Unless otherwise agreed, this may include products displaying customer branding, logos or artwork.
However, we will not intentionally disclose confidential information or use products in a way that suggests endorsement by the customer.
If you would prefer that your completed products are not used for promotional purposes, please let us know before production begins. We will make reasonable efforts to accommodate such requests, particularly where products contain confidential, embargoed or sensitive branding.
Where we create original artwork, layouts or design concepts specifically for you, ownership of the underlying design files, working files and production artwork will remain with Jolly Clothing Ltd unless otherwise agreed in writing.
Upon payment for the agreed work, you will receive the finished artwork or products as specified in your quotation or order.
Any transfer of copyright or ownership in original design work must be expressly agreed in writing and may be subject to an additional fee.
Whilst we exercise reasonable care in handling customer artwork and production files, we cannot accept liability for:
Nothing in this policy excludes or limits liability where it would be unlawful to do so, including liability for fraud, fraudulent misrepresentation, or death or personal injury caused by negligence.
We may update this Artwork & Intellectual Property Policy from time to time to reflect changes in legislation, industry practice or our business operations.
The latest version will always be published on our website.
This policy shall be governed by and interpreted in accordance with the laws of England and Wales.
Any dispute arising in connection with this policy shall be subject to the exclusive jurisdiction of the courts of England and Wales, unless mandatory consumer legislation provides otherwise.
